help!!! rev-limiter stuck @ 3500

ok guys heres the story...so me and my buddy have been workin on an h23 to h22 swap over the past 2 months and we just got the engine runnin last night. we still had a few things to do today so we got everything put back together and then took it for a test drive. i had purchased a new p14 ecu for the vtec switch and they had put a 2-step rev-limiter where unless the car was moving, it would rev-limit @ 3500. when we first started out on our test drive, it wouldn't rev past 3500 period. however after driving around for 2-3 mins., we just about gave up and turned into a driveway to turn around, and after i backed out of the driveway it revved up to 8000 no problem. we then went to the nearest gas station (seeing that we were almost empty) and filled it up. we started it up and it did a repeat (drove for 2-3 mins. and then it finally went past 3500 after that), so i took my friend back home then went to my sisters house and was there for a few hours. on my way home (a good 20 min. drive) it wouldn't rev past 3500 the whole way. any suggestions of why this is happening?
p.s. we changed out the new p14 for the old p13 and it revved up to 7000 just fine even with it just idling (it idled like **** tho but thats just the difference between the ecu's) so anyway im leaving for college monday so i need to know if theres something i can do to get it to rev above 3500 with the new ecu, or if im better off just stickin the p14 back in for the meantime. any help would be appreciated. thanks

from what i read it seems like the company screwed up your ecu. send it back

yea thats the option that i'm so far looking at...jw if someone had any suggestions but i guess for right now il just have to settle with the non-vtec, old ecu
